Terms of Service

Please read these terms carefully. AlbumScan is developed and maintained by an independent developer as a side project. By using this app, you acknowledge the inherent limitations of a solo-maintained service and agree to the terms outlined below.

1. Acceptance of Terms

By downloading, installing, or using AlbumScan ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and AlbumScan ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the App after any modifications constitutes acceptance of the updated Terms.

2. Nature of the Service

2.1 Independent Development

AlbumScan is developed and maintained by a single independent developer as a part-time project. This is not a venture-backed company with dedicated engineering, support, or operations teams. You acknowledge that:

  • The App is maintained on a best-effort basis alongside other professional and personal commitments
  • Response times to issues, bug fixes, and feature requests may vary
  • Development resources are limited and prioritization is at the sole discretion of the developer
  • The service may not receive updates or maintenance indefinitely

2.2 Service Description

AlbumScan provides AI-powered album identification and review generation for vinyl records and music albums. The service relies on third-party APIs and services including, but not limited to, Anthropic's Claude API, OpenAI API, MusicBrainz, and Cover Art Archive.

3. Service Availability and Uptime

3.1 No Uptime Guarantees

WE DO NOT GUARANTEE ANY SPECIFIC LEVEL OF SERVICE AVAILABILITY, UPTIME, OR RELIABILITY. The App is provided on an "as available" basis. You acknowledge and agree that:

  • The service may experience downtime without prior notice
  • We do not offer Service Level Agreements (SLAs) or uptime commitments
  • Maintenance windows may occur at any time without advance notification
  • Third-party service outages (API providers, Apple infrastructure) may affect functionality

3.2 Third-Party Dependencies

The App relies on third-party services for core functionality. We are not responsible for outages, changes, deprecations, or discontinuations of these services. If a critical third-party service becomes unavailable or economically unviable, we reserve the right to modify or discontinue affected features.

3.3 Service Modifications and Discontinuation

We reserve the right to modify, suspend, or discontinue the App or any part of the service at any time, with or without notice, for any reason including but not limited to:

  • Changes in third-party API pricing or availability
  • Economic infeasibility of continued operation
  • Personal circumstances affecting the developer's ability to maintain the service
  • Technical challenges that cannot be reasonably resolved

4. Subscriptions and Payments

4.1 Subscription Tiers

AlbumScan offers the following subscription options:

  • Free Tier: 5 album scans at no cost
  • Base Subscription: Annual subscription providing 120 scans per month with standard identification
  • Ultra Subscription: Annual subscription providing 120 scans per month with advanced search capabilities

4.2 Payment Processing

All payments are processed through Apple's App Store. We do not collect, store, or process payment information directly. All billing inquiries, disputes, and payment issues must be directed to Apple.

4.3 Refund Policy

Due to the nature of digital services and the immediate delivery of value upon subscription activation:

  • No refunds will be issued for subscription fees once a subscription period has begun
  • Refund requests must be directed to Apple through their standard App Store refund process
  • We do not have the ability to issue refunds directly as payments are processed by Apple
  • Unused scans do not carry over between billing periods and are not refundable

4.4 Service Discontinuation and Subscriptions

In the event that we discontinue the service:

  • We will make reasonable efforts to provide advance notice when possible
  • Active subscriptions will not be renewed after the discontinuation announcement
  • No prorated refunds will be issued for the remaining portion of active subscription periods
  • You acknowledge this risk as part of using an independently-maintained service

5. Disclaimers and Limitations of Liability

5.1 "As Is" and "As Available"

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

5.2 No Warranty of Accuracy

Album identification and reviews are generated by artificial intelligence systems. We do not warrant that:

  • Album identifications will be accurate or complete
  • Reviews or assessments will be correct or reflect critical consensus
  • The service will correctly identify all albums or cover art variations
  • Information provided about albums, artists, or release details will be error-free

AI-generated content should be used for informational and entertainment purposes only. Do not make significant purchasing decisions based solely on information provided by the App.

5.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALBUMSCAN, ITS DEVELOPER, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or similar harmful code that may be transmitted through the App
  • Any errors, inaccuracies, or omissions in any content
  • The cost of procurement of substitute goods or services

5.4 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

5.5 Essential Purpose

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Circumvent or attempt to circumvent any usage limits, access controls, or security measures
  • Use automated systems, bots, or scripts to access the service in ways not intended
  • Resell, redistribute, or commercially exploit the service without authorization
  • Abuse the scan limits or subscription system

7. Intellectual Property

The App, including its design, features, and content (excluding third-party materials), is owned by AlbumScan and is protected by intellectual property laws. Album artwork and metadata are sourced from third-party databases and remain the property of their respective rights holders.

AI-generated reviews and assessments are provided for your personal, non-commercial use. You may not republish, redistribute, or commercially exploit AI-generated content at scale without permission.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices regarding your information.

9. Indemnification

You agree to indemnify, defend, and hold harmless AlbumScan, its developer, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact us at james@jamesschaffer.com to attempt to resolve the dispute informally.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

10.3 Waiver of Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. General Provisions

11.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AlbumScan regarding the App.

11.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

11.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
